1. Introduction

This Refund & Cancellation Policy (“Policy”) governs the terms and conditions regarding service delivery, cancellation, and refund eligibility for all services provided by Finovatives through our Platform. Finovatives provides access to specialized digital services, tools, and software solutions (“Services”), which are delivered as intangible digital assets that cannot be returned or resold once accessed. This Policy is designed to clearly communicate that all services offered by Finovatives are non-refundable once delivered and activated. By purchasing or subscribing to any service offered by Finovatives, you acknowledge that you have read, understood, and agree to accept this Policy in its entirety. Acceptance of this Policy is a binding contractual agreement, and refunds will not be issued under any circumstances outlined in this document.

2. Nature of Services Provided

2.1 Digital Service Delivery

Finovatives provides digital services, including but not limited to unified cell tools, technical analysis platforms, market data access, trading utilities, portfolio management features, software solutions, and other technology-based services. These services are delivered electronically and are made available to users immediately upon purchase and account activation. Once a service has been activated and made available to you, it constitutes a delivered service that cannot be recalled, returned, or undone.

2.2 Non-Refundable Service Nature

All services provided by Finovatives are consumable digital products that are immediately used upon access. Unlike physical products that can be inspected, rejected, or returned in their original condition, digital services are consumed at the moment of delivery. Access to our services grants you a license to use the tools, features, and functionality provided, but ownership remains with Finovatives. This digital delivery model inherently means that once you have accessed the service, it cannot be refunded under any circumstances.

2.3 Irreversible Consumption

Services provided by Finovatives are irreversible in nature. Once you begin using the unified cell tool, access market data, utilize trading features, or activate any service component, the service has been consumed and delivered. There is no mechanism to “unconsume” or return a digital service to its pre-purchase state. Therefore, refunds are not applicable to consumed digital services.

3. NO REFUND POLICY

All services provided by Finovatives are strictly non-refundable once purchased and activated. This is an unconditional, absolute policy with no exceptions, alternatives, or compensations. 3.2 No Refund Under Any Circumstances

Refunds will NOT be issued for any of the following reasons:

  • Change of mind or decision to discontinue service use

  • Unsatisfactory experience or dissatisfaction with the service quality

  • Failure to fully utilize or benefit from the service features

  • Technical difficulties or inability to use the service effectively

  • Discovery that the service does not meet your expectations

  • Preference for a competitor’s service or solution

  • Personal, financial, or business circumstances that change after purchase

  • Service underperformance or suboptimal results

  • Misunderstanding of service features or functionality at the time of purchase

  • Device compatibility issues or connectivity problems

  • User error in utilizing the service

  • Regulatory or legal changes that affect your use of the service

  • Market conditions or investment performance resulting from service use

  • Any other reason whatsoever

The only exception to this non-refund policy is if a refund is mandated by a court order, regulatory authority, or law enforcement agency, in which case a refund will be processed as required by law.

3.3 Service Activation Equals Purchase Confirmation

By clicking “Activate Service,” “Confirm Purchase,” “Subscribe Now,” or similar buttons on our Platform, you confirm that:

  • You have read and understood this No Refund Policy

  • You accept that the service is non-refundable once activated

  • You understand that activation constitutes immediate consumption of the service

  • You waive any right to request a refund

  • You take full responsibility for your purchase decision

Activation of service is considered your express acknowledgment and acceptance of this No Refund Policy. Once you activate a service, you cannot rescind or reverse your purchase under any circumstances.

4. Service Access and Usage Terms

4.1 Limited License Grant

Upon purchase and payment, Finovatives grants you a limited, non-exclusive, non-transferable, revocable license to access and use the purchased service for your personal or business use. This license is conditioned on your compliance with all terms outlined in our Terms and Conditions and this Policy. The license does not constitute ownership of the service, and Finovatives retains all rights, title, and interest in the service.

4.2 Access Period

Unless otherwise specified, your access to purchased services continues for the duration of your subscription or license period. Once the subscription or license period expires, your access to the service will be automatically terminated, and you will not be entitled to any refund for the unused portion of the subscription period.

4.3 Immediate Access and Consumption

Services are made available to you immediately upon completion of payment and account activation. By accessing the service, you acknowledge that the service has been delivered and consumed. There is no grace period, trial period after purchase, or opportunity to return the service. Once activated, the service is final and non-refundable.

5. Cancellation Policy

5.1 Subscription Cancellation Options

While Finovatives does not offer refunds for services that have been activated and accessed, you do have the option to cancel future subscription renewals. Cancellation of future renewals will prevent you from being charged in subsequent billing periods, but will not entitle you to a refund for amounts already paid for the current subscription period.

5.2 How to Cancel Subscription Renewal

To cancel future subscription renewals (without obtaining a refund for the current period), you can:

  • Log into your Finovatives account and navigate to “Subscription Settings” and select “Cancel Renewal”

  • Send an email to support@finovatives.com with the subject “Cancel Subscription Renewal” and your account details

  • Call our customer support team at [phone number] during business hours

5.3 Cancellation Effective Date

Cancellation of subscription renewal will take effect at the end of your current billing period. You will continue to have access to the service until the end of the current billing period, after which your access will be terminated. No partial refunds will be issued for the unused portion of the current billing period.

5.4 Reactivation of Cancelled Subscriptions

If you cancel your subscription and later wish to reactivate it, you may do so by logging into your account and selecting “Reactivate Subscription.” Standard pricing will apply to reactivated subscriptions. Any previous balance or credits in your account will be forfeited upon subscription cancellation.

6. Account Suspension and Termination

6.1 Grounds for Account Suspension

Finovatives reserves the right to suspend or terminate your account without refund if:

  • You violate any provision of our Terms and Conditions or this Policy

  • You engage in fraudulent, unlawful, or unauthorized activity

  • You use the service for illegal purposes or in violation of applicable laws

  • You attempt to circumvent security measures or access controls

  • You use the service for hacking, testing security vulnerabilities, or unauthorized system access

  • You engage in harassment, abuse, or threatening behavior toward our staff or other users

  • You create multiple accounts to circumvent restrictions or manipulate the system

  • You share your account credentials with unauthorized individuals

  • You provide false information during registration or verification

  • You engage in reverse engineering, decompilation, or disassembly of our software

  • Your account shows patterns of misuse, such as excessive API calls, system abuse, or resource overload

  • We determine that providing the service to you poses a legal, regulatory, or security risk

  • Non-payment of subscription fees or invoices

6.2 Termination Without Refund

Termination of your account due to violation of our policies or engagement in prohibited activities will result in complete loss of access to all services without any refund of paid amounts. You will forfeit all fees, credits, and balances associated with your account. Finovatives is not obligated to provide notice prior to account termination in cases of serious violations.

7. Payment and Billing

7.1 Non-Refundable Payment Acceptance

By submitting payment for any service, you confirm that:

  • You authorize Finovatives to charge your payment method

  • You acknowledge that the service is non-refundable

  • You accept all terms outlined in this Policy

  • You waive any right to dispute the charge or request a refund based on dissatisfaction

  • You understand that payment constitutes acceptance of service delivery

7.2 Billing Continuation

For subscription services, you authorize Finovatives to charge your payment method on each billing date for the subscription period. Subscription charges will continue automatically until you cancel the subscription. Cancellation only prevents future charges and does not generate refunds for past charges.

7.3 Failed Payment and Account Suspension

If a payment fails due to insufficient funds, expired payment method, or other reasons, Finovatives may suspend your account access until payment is successfully processed. Suspended accounts will not be refunded for the duration of suspension. Your account must remain in good standing to maintain service access.

7.4 Payment Processing Fees

Any payment processing fees, transaction charges, or gateway fees incurred during the purchase of services are non-refundable and are the responsibility of the customer. These fees are separate from the service cost and are charged by third-party payment processors.

8. Service Quality and Performance

8.1 Service Availability

While Finovatives strives to maintain continuous service availability, we do not guarantee uninterrupted access or service performance. Services may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. Such unavailability does not entitle you to a refund.

8.2 Service Performance Disclaimer

Finovatives does not guarantee specific results, outcomes, or performance levels from the use of our services. Services are provided “as-is” and “as-available.” Finovatives makes no warranties regarding service performance, accuracy of data, reliability of features, or suitability for specific purposes. You are solely responsible for evaluating whether the service meets your needs before purchase.

8.3 No Compensation for Service Issues

If you experience technical issues, bugs, feature malfunctions, or service degradation, Finovatives will make reasonable efforts to resolve the issues but will not issue refunds as compensation. We will provide technical support and bug fixes at no additional cost, but service credits, compensation, or refunds are not applicable.

8.4 Data Loss and Recovery

Finovatives is not responsible for loss, theft, corruption, or destruction of your data. While we implement security measures and backups, we cannot guarantee complete data recovery in all circumstances. Data loss does not entitle you to a refund.

9.1 Compliance with Indian Laws

This Policy complies with the Consumer Protection Act, 2019, Information Technology Act, 2000, Reserve Bank of India regulations, and other applicable Indian laws. However, the service nature (digital, consumable, immediately delivered) exempts services from traditional consumer protection refund requirements for goods and physical products.

9.2 Applicability to Digital Services

Digital services, software, and intangible products are exempt from certain provisions of consumer protection laws that apply to physical goods. Once a digital service is delivered and activated, consumer protection laws generally do not provide a right to return or refund such services. This Policy reflects legal standards for digital service delivery.

9.3 E-Commerce Rules Compliance

Under the Consumer Protection (E-Commerce) Rules, 2020, services that are fully delivered or performed cannot be returned or refunded. Finovatives’ services fall under this category as they are fully delivered and consumed upon activation.

10. Dispute Resolution

10.1 Dispute Escalation

If you believe there is an error or issue with your payment or service delivery that requires investigation, you may submit a formal complaint to our customer support team at support@finovatives.com. Your complaint should include your account details, transaction information, and detailed description of the issue.

10.2 Investigation Process

Upon receipt of a complaint, Finovatives will investigate the matter within five to seven business days. If we determine that a billing error occurred (such as duplicate charging, incorrect amount charged, or unauthorized transaction), we will process a refund or credit to your account for the erroneous amount only.

10.3 Fraudulent Transaction Refunds

If you report an unauthorized or fraudulent transaction made without your consent using your account or payment method, we will investigate the claim. If fraud is confirmed, a refund may be issued for the fraudulent charges. However, if you authorized the transaction or shared your credentials with another person who made the purchase, no refund will be issued.

10.4 Regulatory Complaint Escalation

If you are unsatisfied with the resolution of a dispute and believe that Finovatives has violated consumer protection laws or regulations, you may escalate your complaint to:

The arbitration will be conducted in English language and will be governed by Indian law. Each party will bear its own costs unless the arbitrator determines otherwise.
